Using processing time alone can be very misleading. For instance, if you send out ten requests, nine come back in four days, and one request comes back in four months, the average processing time is 15.6 days. However, the case or claim can be stalled for four months while waiting for critical information.
To better gauge performance, consider asking, “What is the absolute longest time it should take to get records?” and “What recourse is available if the records are late?”
With an individual right of access request, providers must respond within 30 days or may face enforcement actions by the Office of Civil Rights. Arctrieval users typically receive 90% of records within 30 days, with the remaining 10% arriving within 45 days of the provider receiving the request.
